Pet-Companion/Performance Puppy



Bonnie Sue O'Neill/MainRouge and Kathy Madden/Montage hereafter referred to as the Sellers, agree to sell the purebred male/female Belgian Tervuren puppy sired by CH MainRouge Let Freedom Ring out of BasqueLaine Ultra Montage HCT, whelped on ________, 2008, in Fredericksburg VA, to _______________________________________, hereafter referred to as the Buyer.

The registered name of this dog will be MainRouge ____________________________________. Both the Buyer and the Sellers anticipate that this dog will be not be used for show or breeding purposes and this contract is structured accordingly. Neither the Buyer nor the Sellers make any promises or representations in this regard other than those stated in this contract.

The total purchase price of this dog is $_______ of which $200 is a deposit and is nonrefundable should the Buyer choose not to finalize the purchase of the puppy. The deposit was paid on _________________. All shipping costs (if any) are the responsibility of the Buyer.

The Sellers will register the puppy and send the AKC papers to the Buyer for transfer of ownership within one week of receipt by Sellers. At the time of sale, this puppy has no appearance of illness and the Sellers will provide a health record of all shots and wormings at the time of delivery. The Sellers guarantee the general health of the puppy for seventy-two (72) hours. During this period, the puppy should be examined by a licensed veterinarian at the Buyer's expense. If this examination reveals that the puppy is in ill health, the Buyer may return it, with a signed veterinary certificate, for a refund. This dog is guaranteed to be sound of temperament; that is, to be neither so shy nor so vicious as to render the dog an unfit companion. This guarantee of temperament is effective only until the dog is one (1) year of age. This guarantee is also contingent upon reasonable proof that any defect in temperament is not the result of lack of proper care or training on the part of the Buyer.

The Sellers guarantee this dog as follows: to be free from hip dysphasia for a period of three (3) years; to be free from epilepsy and inherited eye disorders for six years, such that the dog is not able to pass a CERF exam; and to be free from disqualifying faults as defined by the AKC standard for Belgian Tervuren in effect at the time of sale for two years or until championship is earned, whichever comes first. If the dog develops any of these conditions within the proscribed periods, and they are not caused by accident or the actions of the Buyer, and so long as the Buyer agrees to neuter/spay the dog and furnish it with a loving home for the remainder of its life, the Sellers will provide a puppy that they judge to be of show quality as a replacement from a future litter. No cash refunds will be made, except in the event that the Sellers have reason to choose a refund rather than a replacement puppy. The selection of options will be determined by the mutual agreement of all parties, such agreement to be reasonably and fairly given by each party. If agreement of remedies cannot be reached, both parties agree to submit to and share equally the cost of arbitration. All written proof of alteration must be on the letterhead of the performing veterinarian.

The health guarantee is in effect only if the shot schedule detailed in the puppy packet is followed and no new or additional shots are given.

The Buyer agrees to provide the dog with adequate food, water and medical care. In addition, the Buyer promises to keep the dog as a house pet and to provide it a safe environment to live in, including a fenced yard or run and a dog house, if left outside for more than two hours as a time. The dog will at no time be tethered outside either to a stationary object or on a trolley-type line. The dog will not be allowed to run at large without control or supervision. The Buyer will transport the dog safely, in an enclosed portion of the vehicle, never loose in an open truck bed. If these conditions are not met or in a case of obvious neglect as determined by humane society or animal control officers in the Buyer's jurisdiction or in case of seizure by animal control officers as a stray, the Buyer agrees to give up the dog to the Sellers or their representative(s) on demand, for which no refund will be given.

In the event the Buyer wishes to dispose of the dog in any way, they agree to give the Seller the right of first refusal to reclaim it. If the dog is deemed to be trained, the Seller will endeavor to sell the dog and will furnish the Buyer with the proceeds of the sale, minus reasonable cost for care involved and the cost of any advertising. To be considered trained, the Buyer must supply written proof that the dog has completed at least one course of basic obedience and/or demonstrate that the dog has a reliable knowledge of the commands "come," "sit," and "stay" and is capable of walking calmly on a leash. If untrained, the Buyer may be ineligible for any compensation. If the Sellers do not reclaim the dog and it is subsequently transferred to another party, the Buyer must furnish the Sellers with the name, address and telephone number of the new owner. Ownership of the dog may only be transferred to parties willing to abide by the terms of this contract. Failure to notify the Sellers of the transfer of ownership or other intent to dispose of the dog will result in the Buyer being liable for five thousand dollars ($5,000) in damages.

Buyer agrees to obtain all of the health clearances specified below and to send photocopies of registry certification(s) to Seller promptly upon receipt of the certification(s):

Buyer agrees to spay/neuter the puppy between the ages of 8 to 12 months old. All written proof of alteration must be on the letterhead of the performing veterinarian. Hip and elbow xray screening may be done at the same time as alteration (see below) or done separately if preferred between age 2-3. After age 3, the seller will no longer guarantee hip and elbow OFA results.

   a.  Screening of eyes at age 12-24 months, to be repeated two or more times if possible up until age 8, with results submitted to CERF or equivalent organization.

   b.  Screening of hips and elbows at time of spay/neuter at 8-12 months, or not later than age 3, by xray, anesthesia not required, with results submitted to OFA or equivalent organization.

   c.  Screening for thyroid (full panel including T4) done by Michigan State, Cornell, or a comparable organization via a blood test sent from your veterinarian (copy of report to be provided to Seller), between age 2-3.

Sellers guarantee the dog to be free of the following hereditary diseases, provided that health screening is done within the time frame specified in this contract.

   a.  Hip or elbow dysplasia, such that there is a clinical effect upon the dog in that its condition would greatly affect its lifespan, cause pain and/or disability.

   b.  Eye disease, such that the dog develops a progressive, vision affecting problem, excepting late onset cataracts due to natural aging.

   c.  Primary epilepsy, such that seizures occur regularly without an obvious, non-inheritable secondary cause, such as severe trauma, illness or poisoning.

If the dog develops any of the hereditary diseases as described above, Sellers will offer another puppy when available. If expensive medical treatment is warranted, and Buyer prefers to receive monetary reimbursement toward this instead of a replacement puppy, Sellers agrees to pay for procedures up to but not exceeding the original purchase price of the puppy, contingent upon a second diagnosis from a university affiliated and/or board certified veterinarian of Sellers' choice, and upon receiving copies of all veterinary records and receipts. Sellers will refund the entire purchase price upon return of the dog to Sellers, along with its registration papers, at the Buyer's expense. Euthanasia is only acceptable in cases of severe illness and may not be performed without the consent of Seller.

The Buyer promises not to knowingly breed this dog until (1) it has reached a minimum of three years of age, except with the consent of the Sellers; (2) been certified free of hip and elbow dysphasia (by radiographs certified through the Orthopedic Foundation for Animals no sooner than 24 months of age) and hereditary eye diseases (through annual exams by a veterinary specialist registered with the Canine Eye Registration Foundation); and (3) providing the dog has never had a seizure determined to be epileptic in nature (not an isolated seizure due to illness or injury). If these conditions are met, the dog will only be available at stud on a written contract and only to bitches whose owners use a puppy sale contract that is acceptable to the Buyer. The Sellers promise to update the Buyer annually on the condition of the dam's eyes and to report any seizure activity in the parents or the littermates within ten days of receiving the information and the results of any tests done at that time. The Sellers reserve the right to advise on the suitability of prospective mates.

If this dog is used to produce intentionally mixed-breed or hybrid litters or to produce puppies that are sold or resold to laboratories, guard dog facilities, pet shops, puppy mills, brokers, or other retail or wholesale outlets, the Buyer will be liable to the Seller for the sum of five hundred dollars ($500.00), per puppy, as damages and will return the dog to the Seller with no refund due to the Buyer. Any puppies produced by accidental litters may not be sold for profit.

Any and all suits for the breach or enforcement of this contract shall be brought in Stafford County in the Commonwealth of Virginia, and the laws of the Commonwealth of Virginia shall govern.

Should any portion of this contract become null and void, the remainder of the contract shall remain in full effect. This written contract contains the entire agreement of the parties and no other statement, promise, or inducement made by either party is binding. Any modifications to this agreement can only be made in writing and must be signed by all parties.

This contract shall remain in force and effect for the life of the dog, except as provided otherwise herein, and shall be binding on all assignees, transfers and purchasers of this dog.
